General provisions — including liability rules for the carriage of passengers and/or vehicles
Transport of sick and disabled persons
For invalid cars, the company meets any wishes that may be with regard to parking close to the lounge on the car deck, as far as possible. The shipping company may require sick/disabled persons to have their own companion during the crossing. Such a companion is transferred free of charge. The company does not undertake on board or in the landing of sick persons unless the disease has occurred during the crossing.
Domestic animals must be kept on a leash or stored in suitable boxes/boxes. It is allowed to leave dogs and other animals in the car during the crossing. The company is not responsible for live animals carried by a passenger as goods. Under no circumstances shall animals be on the seats in salons.
The transfer shall not include travel goods, including hand luggage and other goods, which may cause danger or significant inconvenience to the ship, life or other goods, including none of the substances and goods for which transfer is not permitted under the IMDG Code.
A - General carriage of goods
All trucks/vans with a maximum weight greater than 3,500 kg or a length of more than 6 m are referred to as trucks.
In addition, the provisions of the Baltic Sea Agreement apply to vehicles used for the carriage of goods and goods, including buses for passenger transport.
On-board and on-shore travel shall be carried out in cooperation with the staff and shall be carried out with particular care on the part of the driver.
Goods on vehicles must be sufficiently lashed and secured to withstand any effects that may occur during a maritime transport. The driver is responsible for ensuring that the load is securely lashed and secured on his own vehicle. The company is not obliged to examine trailers, containers or other transport devices with regard to the packing, stowage, or lashing of the goods. If, in spite of this, the shipping company considers that the goods are not properly packed, the company may refuse to transfer the goods. The company shall not replace damage to goods or vehicles where the damage is caused by defective lashing, stowage or other conditions which are the responsibility of the driver to ensure and which the company is not particularly obliged to ensure. The captain or mate has the final say on load protection/lashings, and whether the load should be rejected.
Damage to goods or cargo must be reported immediately upon receipt at the port of arrival before it leaves the area. If this is not respected, the right of complaint lapses. The company accepts no liability for any damage to lorries and goods that remain on the land of entry and port in accordance with current case law.
B - Dangerous goods
Dangerous goods are transported in accordance with the provisions of the IMDG Code.
The consignor of goods is obliged to inform the shipping company in advance of the presence of dangerous goods at least 24 hours before the transport is to take place. If such information has not been provided, the consignor shall be deemed to have assured the shipping company that the goods surrendered for transport do not contain dangerous goods.
In the transport of motor vehicles carrying dangerous goods, the necessary documents must be present before transfer. Labelling and packaging shall be carried out in accordance with the rules in force. The company reserves the right to verify that the cargo corresponds to the notification and has the right to refuse or postpone the shipment of dangerous goods.
C - Transport of live animals
When transporting live animals, the driver must inform you of this no later than when boarding. Upon contact with the staff, the animals may be authorised during the crossing. The company assumes no responsibility for the transfer of live animals.
D - Business goods and express parcels
In the case of freight of commercial goods and express parcels, packages must be delivered in connection with the ferry's departure and picked up in connection with the ferry's arrival. The customer must make sure that the packages come on board the ferry and off the ferry again.
E - Checkweighing
The company is entitled to check trailers for verification of the weight of the trailer declared at the time of booking. If the checkweighing shows that the trailer exceeds the declared weight, the company may issue a charge to the customer to cover the costs of weighing, extra handling and administration.
The crew shall be entitled to reject a trailer which, when welded by means of a check, has been shown to exceed the weight declared at the time of booking.
F - Offsetting ban
At no time is the customer entitled to set off claims or other claims against the company against the ticket price or the company's related receivables.
G - The recommending of goods
Goods recommended on the re-entry areas of the company's ferry berths are at the customer's own expense and risk. The company shall be deemed to have received the goods at the earliest at the time when the boarding/ loading of the cargo commences by the company's personnel.
If the customer does not pick up the goods immediately after the company's staff has brought it ashore, the goods are recommended at the customer's own expense and risk, jvf. Section 274(3) (2) of the Danish Maritime Act, recommending the goods in areas that are only to a limited extent monitored and secured. The customer is therefore encouraged to secure the goods in the best possible way.
Payment of tickets
When booking a ticket online, you are paid by credit card. In the office, tickets can be purchased by credit card and cash. On the ferry, tickets can be paid by credit card and cash. There may be a payment fee associated with the use of certain credit cards. This will be stated before the payment has to be approved by the passenger. Upon receipt of the ticket or card, the passenger shall ensure that the ticket issued corresponds to the requested one. The company is entitled to charge cancellation fees for late cancellation of a reserved seat or non-attendance, as cancellation must be made no later than before scheduled departure. The company is also entitled to then set aside the reserved space for the other side. Travel agencies, bus companies and freight customers can request a credit agreement. The company may refuse to enter into a credit agreement or require collateral in the form of a bank guarantee in order to enter into a credit agreement. The company does not enter into a credit agreement with private individuals.
10-trip card or unused clips will be refunded if requested by the company's office before the expiry of the card.
Other tickets will be refunded if cancellation takes place within 30 minutes of departure. Lost tickets will not be refunded. If a customer has lost or misplaced their ticket, a new one must be purchased.
No ticket is checked from Ærø. Tickets are checked and sold against Ærø. In a situation where a traveller does not have a valid ticket and is unable to pay a valid ticket, he or she must provide his or her full name, address and date of birth. In addition, the passenger concerned must identify himself by driving licence or other legal document. The company will subsequently send a fare charge and a surcharge of DKK 300 to cover administration. Personally issued tickets and cards are withdrawn by found abuse without compensation.
The company accepts no liability for any loss or damage caused by any lack of space on the ship, disruption to operations, including cessation of operations due to irregularities, including Force Majeure, technical reasons, water and weather conditions. In addition, the company reserves the right to make changes to the schedule and fares without notice. The company is never responsible for losses incurred as a result of lost traffic links or necessary changes in travel plans. The company's compensation in case of delay or cancellation can never exceed the price of the ticket.
Compensation for damage to person, vehicle and baggage
When carrying passengers, the company is exempt from liability for the time before the passenger boards and after the passenger has landed. The company is not liable for any loss or damage to money, securities and other valuables, such as silver, gold, watches, jewels, jewelry and works of art. On-board and land-based vehicles are carried out at their own risk and without responsibility for the company. It is the passenger's duty to keep his vehicle securely braked during transport by putting the vehicle into gear and pulling the handbrake.
Damage to vehicles caused by lowering, converted or heavily loaded vehicles is irrelevant to the shipping company. Special equipment, including travel goods, placed on the outside or on top of a vehicle and damaged, but in motion, shall not be replaced, regardless of other liability. It is the passenger's own responsibility to lash the bicycle, motorcycle, moped, scooter or the like, and it is always the responsibility of the passenger to ensure that the vehicle is sufficiently stable and secured to withstand generally expected sea crossings on the crossing. Damage to such vehicles as a result of overturning or dislocation during the crossing is irrelevant to the shipping company.
Notification of damage to personal property, vehicles, luggage or cargo must be addressed immediately to one of the company's crew members before leaving the ferry. Complaints about damage caused during the journey, which have not been resolved by contacting the company's staff on board, can be submitted to the company's office.
